1. The agreement

By buying a TrakInfinity device, using the TrakInfinity app, or using this website, you agree to these terms. If you do not agree, please do not use the service.

In these terms, "we" and "us" mean Infinite Telematics Pvt Ltd, and "you" means the customer.

2. What we provide

We supply a GPS tracking device, install it in your vehicle, and provide a service that reports the vehicle position to our servers and makes it available to you through the TrakInfinity mobile app.

The plan you buy determines which features are enabled on your device and how many years of service are included in the price you pay.

3. Installation

Installation by our technician is included in the price. For most vehicles we use a plug-in wiring harness made for that model, so that original wiring is not cut or spliced.

You confirm that you own the vehicle, or that you have the vehicle owner’s permission to have a tracking device fitted to it.

If your vehicle requires non-standard fitting, we will tell you before any work is carried out.

4. Your responsibilities

• Give us accurate information about yourself and your vehicle.
• Keep your app login details confidential, and tell us if you think someone else has access to your account.
• Use the service only for lawful purposes, and only in relation to a vehicle you own or are authorised to track.
• Do not tamper with, open, relocate or attempt to modify the device yourself.
• Tell us if you sell or transfer the vehicle, so the device and account can be handled properly.

5. Tracking other people

You must not use a TrakInfinity device or the app to track a person, or a vehicle, without the legal right to do so. Fitting a tracking device to someone else’s vehicle without their knowledge or consent may be unlawful.

You are responsible for making sure that anyone who regularly drives your vehicle knows that a tracking device is fitted. We may suspend or terminate service where we have reason to believe it is being used unlawfully.

6. What the service can and cannot do

The service depends on GPS satellite signals and on mobile network coverage, neither of which we control. Location reporting may be delayed, interrupted or unavailable in underground parking, tunnels, areas without mobile coverage, or where signals are obstructed or deliberately jammed.

The engine immobiliser feature, where included in your plan, is designed to prevent a stationary vehicle from being started. It is not designed to stop a vehicle that is already moving and must not be relied on to do so.

A tracking device is a tool that helps you monitor and recover a vehicle. It is not a guarantee against theft, damage or loss, and it does not replace insurance.

7. Service availability

We aim to keep the service running continuously, but we do not guarantee uninterrupted availability. Service may be unavailable during maintenance, or because of failures in networks, satellites or infrastructure outside our control.

We may make changes and improvements to the app and the service. We will not remove a core feature of the plan you paid for without telling you.

8. Payment

Prices shown on this website are in Indian Rupees and are for the device, its installation and the number of years of service stated with the plan.

We confirm the final price, including anything specific to your vehicle, before any work is carried out.

9. Suspension and termination

We may suspend or terminate your service if you breach these terms, if we reasonably believe the service is being used unlawfully, or where we are required to do so by law.

You may stop using the service at any time. If you want to stop, contact us and we will tell you what that means for your device and your account.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of business or loss of the vehicle itself, arising out of the use of or inability to use the service.

Nothing in these terms limits our liability where it cannot lawfully be limited, including for death or personal injury caused by our negligence, or for fraud.

Our total liability in connection with the service will not exceed the amount you paid us for it.

11. Intellectual property

The TrakInfinity name, logo, app, website and their content belong to us. You may not copy, reproduce or reuse them without our written permission.

12. Privacy

Our handling of your personal data, including vehicle location data, is described in our privacy policy, which forms part of these terms.

13. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last changed. Continued use of the service after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of India. The courts at New Delhi have exclusive jurisdiction over any dispute arising from them.
